Available in PDF, EPUB and Kindle. Book excerpt: Hundreds of thousands of the inmates who populate the nation's jails and prison systems today are identified as mentally ill. Many experts point to the deinstitutionalization of mental hospitals in the 1960s, which led to more patients living on their own, as the reason for this high rate of incarceration. But this explanation does not justify why our society has chosen to treat these people with punitive measures. In Crime, Punishment, and Mental Illness, Patricia E. Erickson and Steven K. Erickson explore how societal beliefs about free will and moral responsibility have shaped current policies and they identify the differences among the goals, ethos, and actions of the legal and health care systems. Drawing on high-profile cases, the authors provide a critical analysis of topics, including legal standards for competency, insanity versus mental illness, sex offenders, psychologically disturbed juveniles, the injury and death rates of mentally ill prisoners due to the inappropriate use of force, the high level of suicide, and the release of mentally ill individuals from jails and prisons who have received little or no treatment.

Book excerpt: Judith Rumgay explores theoretical explanations of the alcohol-crime relationship, critically analyses their empirical support in research, and develops a perspective based on 'expectancy theory', which suggests that alcohol facilitates offending less through its real pharmacological effects than through the variety of common sense beliefs about those effects which are embedded in everyday life. An empirical study of magistrates' sentencing decisions illuminates the diversity of explanations for crime based on intoxication, through the appeal to common sense beliefs about alcohol's effects.

Available in PDF, EPUB and Kindle. Book excerpt: In the globalized world an extensive process of international migration has developed. The resulting conundrum of issues when examining crime and migration makes for a bitterly complex and intriguing set of debates. In this compelling account, Dario Melossi provides an authoritative take on the theory and research examining the connection of crime, migration and punishment. Through a socio-historical and criminological approach, he shows that the core questions of migrants' criminal behaviour are tightly related to the rules and practices of migrants’ reception within the various countries’ social and normative structures. Written for students, academics, researchers and activists with an interest in the topic, the book will appeal to individuals in a range of disciplines, from criminology and sociology to politics, international relations, ethnic studies, geography, social policy and development. Compact Criminology is an exciting series that invigorates and challenges the international field of criminology. Books in the series are short, authoritative, innovative assessments of emerging issues in criminology and criminal justice – offering critical, accessible introductions to important topics. They take a global rather than a narrowly national approach. Eminently readable and first-rate in quality, each book is written by a leading specialist. Compact Criminology provides a new type of tool for teaching, learning and research, one that is flexible and light on its feet. The series addresses fundamental needs in the growing and increasingly differentiated field of criminology.

Available in PDF, EPUB and Kindle. Book excerpt: Can restorative justice be applied to a full range of offenses? Ross London answers with an unequivocal "Yes." London proposes that, by focusing on the restoration of personal and social trust, restoration may become acknowledged as the overarching goal of all criminal justice policies and practices. While supporting the use of restorative justice as a non-punitive alternative for appropriate cases, London argues that deserved punishment for serious offenses--far from contradicting the goal of restoration--may be instrumental for the emotional recovery of crime victims, the security of communities, and for the successful reintegration of offenders. Moreover, this approach responsibly minimizes resort to punishment by maximizing all of the many other means of restoring trust. Drawing on his experience as a judge, prosecutor, and public defender, London offers a pragmatic vision of restorative justice that integrates its core values with real-world applications for even the most serious violent crimes.

Available in PDF, EPUB and Kindle. Book excerpt: 'the love of my life'... John Ward, writing whilst incarcerated on Norfolk Island, tells a story of thwarted love that–he claims–led him to a life of crime: including theft, sexual assault and more. In telling the candid story of his downfall he exposes his own ruthlessness and lack of empathy. This book, using the diary as its base, is fascinating on so many levels. It is an insight into the criminal mind, ably examined by author June Slee. It is a glimpse into 19th–century aristocratic life–dress, food, pastimes and prejudices–from a servant's perspective (Ward was a groom to an officer gentleman). And it is a unique record, perhaps the only extant diary ever written during the Australian penal era whilst its convict writer was imprisoned. Plus, Ward records a particular moment in our history: not only life aboard prison hulks which he describes in detail but also the timing of his arrival in Sydney when convicts were no longer being accepted; he was sent straight to Norfolk Island where we get a fascinating insight into the rule of Captain Alexander Maconochie. Moconochie believed in a system of improvement for convicts based on a marks system for good behaviour rather than humiliating punishment. In this way, Ward gained access to writing materials for his diary. It's all in this book: love, history, convicts, crime and criminology, Norfolk Island ... The author weaves the diary – Ward’s own words – into her text seamlessly to tell a gripping story. Illustrated with over 150 images including paintings, photographs, documents, newspapers and drawings, the book includes text box features that elucidate aspects of life at the time: oyster bars and eating out, disease, smuggling, county justice, convict marriage, convict class and society, the end of transportation, and more. June Slee is an experienced writer and researcher, lecturer and practitioner in the field of criminology, particularly relating to the Australian convict era. Slee was immediately drawn to Ward’s story, not just for its insight into 19th-century crime and punishment, but also for its outstanding literary style and rarity as a diary that was written while its author was still incarcerated. Currently she is completing another book on convictism and has plans for two further books. June currently lives in New Zealand

Available in PDF, EPUB and Kindle. Book excerpt: In Crime, Punishment and Disease, Antony Flew makes clear both the meaning and the implications carried by the application of the expression "mental disease." He aims to discourage its use in conditions that provide the victims of such diseases with an excuse for failing to perform what would have been their imperative duties had they enjoyed good mental health. Flew attacks the gross over-extensions of the notion of mental disease on both sides of the Atlantic. He defends human dignity and responsibility against the suggestion that we are all, or most of us, "sick, sick, sick." In particular, he challenges the paternalist pretensions of people who claim a right to control and manipulate others because they are allegedly sick, and consequently not responsible for what they do.In a typical ordinary disease, Flew notes, it is the patient who complains of the disease rather than someone else who complains about the patient. But those who claim that some crime or all crime is symptomatic of mental disease and those who identify disorders such as attention/deficit/hyperactivity disorder (ADHD) as conditions requiring psychiatric attention are taking the disfavored behavior rather than the distress of their patients as the warrant for supposedly medical interventions. They should instead first consider how what they propose to call mental disease does, and does not, resemble syphilis, measles, and other communicable diseases.Flew sees his work as complementary to Thomas Szasz's. He applies a philosophical perspective to problems Szasz discusses as a psychiatrist. This work will be of particular interest to students of philosophy and politics, in that it relates modern discussion of mental illness to the Plato of The Republic. Flew also takes note in this context of Samuel Butler's Erewhon. This work will be of direct relevance to criminologists, as well as those interested in social welfare, philosophy of education, and new developments in psychiatry.

Available in PDF, EPUB and Kindle. Book excerpt: For many years, Antony Duff has been one of the world's foremost philosophers of criminal law. This volume collects essays by leading criminal law theorists to explore the principal themes in his work. In a response to the essays, Duff clarifies and develops his position on central problems in criminal law theory. Some of the essays concentrate on the topic of criminalization. That is, they examine what forms of conduct (including attempts, offensiveness, and negligence) can aptly qualify as criminal offences, and what principled limits, if any, should be placed on the reach of the criminal law. Several of the other essays assess the thesis that punishment is justifiable as a form of communication between offenders and their community. Those essays examine the presuppositions (about the nature and function of community, and about the moral structure of atonement) that must be embraced if communication is to be a primary role for punishment. The remaining essays examine the nature and limits of responsibility in the law, as they engage with philosophical debates over 'moral luck' by investigating the ways in which the law can legitimately hold people responsible for events that were not within their control. These chapters tie the first and third parts of the book together, as they explore the relationship between the principles that determine a person's responsibility and the principles that determine which types of actions can appropriately be criminalized. Finally, Duff responds with comments that seek to defend and clarify his views while also acknowledging the correctness of some of the critics' objections.

Available in PDF, EPUB and Kindle. Book excerpt: We now live in a world which thinks through the legislative implications of criminal justice with one eye on human rights. Human Rights and the Criminal Justice System provides comprehensive coverage of human rights as it relates to the contemporary criminal justice system. As well as being a significant aspect of international governance and global justice, Amatrudo and Blake argue here that human rights have also eclipsed the rhetoric of religion in contemporary moral discussion. This book explores topics such as terrorism, race, and the rights of prisoners, as well as existing legal structures, court practices, and the developing literature in Criminology, Law and Political Science, in order to critically review the relationship between the developing body of human rights theory and practice, and the criminal justice system. This book will be of considerable interest to those with academic concerns in this area; as well as providing an accessible, yet sophisticated, resource for upper level undergraduate and postgraduate human rights courses.
